Creativ Freedom – Intellectual Property & Source File Policy

This document serves as an official disclaimer regarding all requests for PSD files, source files, and raw editable design files created by Creativ Freedom.

 

WHAT IS A RAW/PSD FILE? A RAW or PSD file is the complete editable blueprint of a design. It contains:

  • Licensed and purchased fonts

  • AI-generated prompts, iterations, and assets

  • Layered backgrounds and merged visual elements

  • Color treatments, effects, and blending modes

  • Proprietary workflows, structure, and creative techniques

These files provide full access to the internal construction of the artwork, far beyond the final PNG/JPG/PDF deliverables.

 

INTELLECTUAL PROPERTY NOTICE

All raw, layered, and editable design files are considered the intellectual property of Creativ Freedom. They are not included in standard design packages or final deliverables. These files contain proprietary assets, paid licenses, and unique creative processes developed specifically for Creativ Freedom projects. For this reason, RAW/PSD files are protected materials and are not complimentary.

 

REQUESTS FOR SOURCE FILES

If a client requires the PSD or raw editable file for future edits or external use, a custom quote will be provided.  Pricing depends on the complexity of the file and the assets contained within it. Final artwork files (PNG, JPG, PDF, etc.) remain included in the project at no additional cost.

 

AI-GENERATED ASSETS

  • Many Creativ Freedom designs include enhanced or fully custom imagery created through AI prompt engineering (e.g., Midjourney). These assets include:

  • Original prompts

  • Variations and iterations

  • Custom upscaling AI-generated backgrounds, subjects, and visual elements

  • Manual edits applied to refine the AI output

 

These AI-created elements are treated the same as custom artwork or licensed stock assets, and therefore increase the value and ownership rights of the raw file. Because of this, PSD files containing AI-generated assets may require additional licensing or release fees.

 

USAGE REMINDER

Receiving a final design does not grant ownership of the raw file, font licenses, creative formulas, or internal design structures used to create it. Source file access is only provided upon request and after approval and payment of the associated licensing + intellectual property release fee.

LICENSE & USAGE LIABILITY NOTICE

Some Creativ Freedom designs may contain assets that require individual licensing, including:

  • Purchased fonts

  • Paid stock images

  • Third-party textures or overlays

  • AI-generated elements that include proprietary enhancements

  • Effects or assets governed by external copyright terms

 

If a PSD or raw file containing these assets is released to a client, it is the client’s responsibility to ensure they obtain the necessary licenses for any materials they intend to edit, reuse, or redistribute.

 

Use of unlicensed assets may result in:

  • Copyright violations

  • DMCA takedown notices

  • Fines or legal action from font foundries or asset creators

  • The client being required to remove or replace unlicensed elements

  • Loss of usage rights for the final design

Creativ Freedom is not liable for any legal, financial, or copyright issues resulting from the client’s misuse or unauthorized reuse of licensed or proprietary assets once a raw file has been released. By requesting or accepting a PSD or raw file, the client acknowledges full responsibility for verifying and securing any required licenses.

LEGAL NOTICE: All policies contained in this document are supported by established creative-industry standards and U.S. copyright law. Under Title 17 of the United States Code, Creativ Freedom retains full copyright ownership of all original work, including layered files, compositions, and AI-generated assets, unless rights are explicitly transferred in writing. Source files may contain licensed fonts, purchased stock images, overlays, or AI-enhanced elements that are governed by third-party licensing agreements (including but not limited to EULAs from font foundries and licensing terms from platforms such as Adobe Stock, Shutterstock, Getty Images, and Midjourney). These assets cannot be redistributed, repackaged, reused, or transferred without proper licensing from their respective owners. By requesting or accepting a PSD or raw editable file, the client assumes full responsibility for securing any necessary licenses for continued use, modification, or redistribution of included assets. Creativ Freedom is not liable for any copyright violations, DMCA actions, financial penalties, or legal consequences arising from unauthorized use after file release.
